Fletcher Construction (and our related entities) are committed to protecting any personal information that we may collect about you. 

This Privacy Statement explains how and why we collect, use, store, and share personal information. It applies to personal information we collect directly from you or from third parties when you interact with us, our websites, or our services.

Personal information means information about an identifiable individual, such as your name and contact details. We collect and use personal information only where necessary for legitimate business purposes, take reasonable steps to keep it secure, and respect your right to access and correct your information, in accordance with the Privacy Act 2020. 

Collection and use of personal information  

We collect personal information to operate our business, respond to enquiries, provide products and services, manage customer, supplier and contractor relationships, and support recruitment and employment processes.

Most personal information is collected directly from you when you interact with us, including when you make an enquiry, complete an online form, apply for a role, contact us by phone or email, visit our premises, or use our websites, digital platforms or services. 

The information collected may include (but not limited to) your name, contact details, identification or verification information, recruitment or employment-related information, account or login details, financial and transactional information, correspondence with us, marketing preferences, feedback, complaints, survey responses, and information about products or services you have purchased or enquired about.

In some circumstances, we may collect personal information indirectly from third parties, such as recruiters, labour hire agencies, customers, suppliers, marketing agencies, service providers, credit reporting agencies, publicly available sources, or others who are authorised to provide that information to us. Where this occurs, we rely on those third parties to have collected and shared the information lawfully.

How we use personal information

We use personal information to:

  • provide, administer, improve and support our products, services and digital channels;
  • communicate with you, respond to enquiries, manage applications and keep our records accurate;
  • manage transactions, warranties, repairs, invoicing, account management and credit processes (where applicable);
  • conduct analytics, surveys and research to improve our services and understand engagement;
  • provide marketing, offers, promotions, events and communications within the Fletcher Building Group, subject to your preferences;
  • manage recruitment, employment and internal personnel services;
  • protect the safety and security of our people, sites and systems, including preventing and investigating fraud or other harmful activity;
  • manage health, safety and wellbeing, including incident investigation and reporting; and
  • comply with applicable laws, regulations and reporting obligations, or for any other purpose notified to you at the time of collection or authorised by you.

Websites, cookies and digital tracking 

When you visit our website or use our digital services (including website), certain information may be automatically collected through cookies, trackers or similar technologies. This may include the date and time of your visit, IP address, location data (if enabled), browser type, device and operating system information, system configuration data, and details about how you interact with our website and digital platforms. This information is collected to:

  • operate, maintain and secure our website and digital services;
  • understand how our website is used and improve functionality and user experience;
  • monitor performance and diagnose issues; and
  • measure the effectiveness of our communications, marketing and advertising.

Cookies are small data files stored on your browser or device. Some cookies are deleted when you close your browser, while others remain for a period of time to recognise return visits. We and certain third parties use cookies to provide site functionality, analyse usage patterns, and improve our websites, products and services.

Cookies do not usually identify you directly as an individual; however, if you access secure areas of our digital services, cookie or analytics data may be linked to your account information for the purposes described in this statement. You can manage or disable cookies through your browser settings, although this may affect website functionality.

Analytics, advertising and marketing

We use third‑party analytics and advertising tools (such as Google Analytics, Google and Facebook) to:

  • analyse user behaviour (for example, page views, visit duration, device type and traffic sources);
  • monitor and improve digital platform performance; and
  • assess and optimise the effectiveness of our advertising.

If you access secure areas, we may combine analytics data with identifying information for the purposes set out in this Privacy Statement. 

We may use AI tools to help process and analyse personal information more efficiently, including to improve services, personalise experiences, and support fraud detection and security. Decisions that could significantly affect your rights are either made by humans or can be reviewed by humans. We are committed to responsible and lawful use of AI.

Our website may include links to third‑party websites, social media features (such as “like” or share buttons), or embedded content. These third parties may collect information about your interactions with our website in accordance with their own privacy policies. We do not control and are not responsible for the privacy practices of those third parties. We encourage you to review their privacy policies before engaging with them. We may provide application programming interfaces (APIs) that allow third‑party applications to connect with our digital platforms, including authentication using Fletcher Construction credentials. 

Workplace monitoring 

We may also collect images or recordings within out workplaces or business premises through lawful security or monitoring systems, such as CCTV or access controls, or other on‑site safety and security measures. This information is collected for legitimate business purposes such as maintaining safety, security and operational integrity, and where we are required or authorised by law to do so.

Some personal information is therefore collected using technology or automated means. We take reasonable steps to ensure individuals are aware of this collection, the purpose for which the information is collected, and how it will be used. We only collect personal information that is reasonably necessary for our functions or activities and handle it in accordance with the Privacy Act 2020.

Sharing, storage and security of personal information

We will only share personal information with others when we are legally permitted to do so. When we share information with others, we put contractual arrangements and security mechanisms in place to appropriately protect the information and to comply with our data protection, confidentiality and security standards.

In some instances, it may be necessary to transfer your information outside of New Zealand. When we do so, we take appropriate measures to safeguard your information.

We may share your personal information with a range of organisations and individuals, including (but not limited to):

  • our contractors, service providers and technology partners who support our operations, including providers of IT systems, cloud‑based software, data hosting, analytics, security, identity management, website hosting, data storage and backup services;
  • organisations we work with in joint ventures or other business arrangements where information is required to conduct our business;
  • credit reporting agencies (including Equifax, CreditWorks and Centrix) if you apply for credit with us, including to obtain credit reports or to disclose credit information where credit is provided or payments are overdue;
  • marketing, research and data analysis providers who assist us with communications, surveys, market research and business insights;
  • other organisations involved in an actual or proposed sale, transfer, restructure, merger or acquisition of part of our business; and
  • government agencies, regulators, law enforcement agencies or other third parties where disclosure is required or authorised by law, or is necessary to assist with the investigation or prevention of fraud, criminal activity, or to prevent or lessen a serious threat to health or safety. 

We may also share personal information with any other recipient notified to you at the time of collection or authorised by you.

Where we receive requests from the police or other government agencies, we only disclose personal information where permitted or required by law, such as in response to a production order, with your consent, to assist with legal proceedings, or to prevent or lessen a serious threat.

Some of our service providers may store or process personal information outside New Zealand (including in Australia or other jurisdictions). Where personal information is transferred overseas, we take reasonable steps to ensure it is protected and handled in a manner consistent with the Privacy Act 2020.

Storage, retention and security

Personal information may be stored in physical files or electronically in secure data centres operated by us or our authorised service providers in New Zealand, Australia or other overseas jurisdictions.

We take reasonable steps to protect personal information against loss, misuse, unauthorised access, disclosure, alteration or destruction. This includes technical, physical and organisational safeguards such as access controls, secure systems, security monitoring, internal policies and employee training.

We retain personal information only for as long as necessary to fulfil the purposes for which it was collected or as required by law, regulation or contractual obligations. Unless a different retention period applies, personal information is generally retained for up to seven years, after which it is securely destroyed or de‑identified.

Access, correction and deletion

We take reasonable steps to ensure personal information we hold is accurate, complete and up to date. You may request access to, or correction of, personal information we hold about you, or request deletion where appropriate.

A reasonable fee may be charged to cover the administrative costs of processing a request. In some circumstances, access to or correction of personal information may be declined in accordance with the Privacy Act 2020. If this occurs, we will explain the reason and advise you of your right to complain.

If you have a privacy concern, complaint or question, please contact our Privacy Officer. We will acknowledge your concern and do our best to resolve it internally.
